Costco Sues to Overturn Trump Administration Tariffs in Court

Costco Wholesale has officially filed a lawsuit in the International Trade Court, challenging the tariffs imposed by the Trump administration. The retail giant claims that the government misused the International Emergency Economic Powers Act (IEEPA) to enforce these tariffs. As part of the lawsuit, Costco is seeking a full refund of the import duties it has paid since the tariffs came into effect.

While Costco is not the first to take action against these tariffs, its lawsuit is significant due to the company’s substantial market presence. Although Costco has not disclosed the exact amount it seeks to recover, data from the U.S. Customs and Border Protection reveals that importers have collectively paid nearly $90 billion under the IEEPA by the end of September 2023. The company asserts that the government has retained funds that rightfully belong to importers.

The legality of the Trump administration’s tariff decisions is currently under scrutiny by the Supreme Court. Following rigorous questioning of Solicitor General D. John Sauer, the court appears to have raised doubts about the constitutionality of the tariffs. Costco’s Chief Financial Officer, Gary Millerchip, emphasized that the company is experiencing negative effects due to these tariffs, particularly as it strives to keep prices stable for its customers. Millerchip stated, “We have kept the price on those to ensure that we are protecting the member.”

Costco’s legal team argues that the IEEPA does not grant the President the authority to impose tariffs, stating that “the Challenged Tariff Orders cannot be upheld and the defendants are not authorized to implement or collect them.” This case adds further weight to the ongoing discourse surrounding the economic implications of the tariffs.

Broader Context and Industry Impact

The tariffs have had a considerable impact on various sectors. According to Millerchip, approximately one-third of Costco’s sales in the U.S. involve imported products, with 8% originating from China. As the company navigates these challenges, it continues to explore ways to mitigate the impact on its supply chain, including shifting production locations and consolidating purchasing efforts.

As of late October 2023, the U.S. government has collected a staggering $205 billion in tariffs. This figure underscores Costco’s assertion that the government is holding onto funds that do not belong to it. Other companies, including Revlon, EssilorLuxottica, and Kawasaki, have also filed lawsuits against the Trump administration regarding similar issues. The addition of Costco to this list elevates the legal battle, potentially influencing the outcomes of these cases.

White House spokesperson Kush Desai remarked on the situation, stating, “The economic consequences of the failure to uphold President Trump’s lawful tariffs are enormous, and this suit highlights that fact.” The White House has expressed hope for a “quick and appropriate” resolution to the ongoing legal matters.
