Judge Reverses Release of Oakland Rape Suspect, Jails Lewis Again
UPDATE: A shocking turn of events has unfolded in Oakland as Judge David Pereda has ordered the immediate jailing of Lester Lewis, a 76-year-old suspect charged with horrific crimes, citing his unexpectedly improved health. This urgent decision comes just six months after the Alameda County District Attorney’s office agreed to release him due to concerns over his deteriorating medical condition.
Lewis is accused of brutally assaulting a woman in his apartment, including beating and burning her, as she succumbed to a suspected drug overdose. Authorities allege he filmed himself committing these acts before callously dragging her body to a stairwell on the 1300 block of 81st Avenue. On October 27, 2023, during a hearing, Judge Pereda expressed grave concerns over Lewis’s release, stating, “Mr. Lewis’ health has dramatically improved, and there has been no showing that his condition is significantly different from when he allegedly committed this horrendous act.” This reversal highlights the ongoing struggle between the justice system and the complexities of medical assessments in serious criminal cases.
Initially, prosecutors had agreed to Lewis’s release after receiving information suggesting he was nearing death. In a March communication, Deputy Public Defender George Arroyo had informed the court that Lewis was likely in his “last moments” and requested a release order for family support, believing he would not survive long enough to face trial. However, after Lewis’s condition stabilized, the prosecution swiftly moved to have him jailed again, arguing that had they known he would recover, they would have opposed the initial release.
Deputy District Attorney Olivia Suraci emphasized the prosecution’s shock at Lewis’s recovery, stating, “Had I known the defendant would be healthy enough to be discharged from the hospital a few months later, I would have objected to the release.”
The legal battle now continues as Lewis faces serious charges, including the alleged rape and abuse of a deceased or dying woman, a situation that has drawn national outrage. His preliminary hearing is tentatively scheduled for next week, where he is expected to plead not guilty.
