The incident occurred on October 10, 2023, when Judge Emil Bove of the U.S. Court of Appeals for the Third Circuit was spotted at Trump’s rally at the Mount Pocono casino. Attendees reported that Bove’s presence at the event, which featured a politically charged speech from the president, breaches the Code of Conduct for U.S. Judges.

In a speech lasting over 100 minutes, Trump addressed various issues, including the economy and immigration, while attacking “the radical left” and Democrats. When questioned about his attendance, Bove claimed he was “just here as a citizen coming to watch the president speak.” However, critics argue this statement fails to acknowledge the highly politicized nature of the event.

According to Gabe Roth, executive director of Fix the Courts, Judge Bove’s attendance contravenes several ethical guidelines. Roth stated in a letter accompanying the complaint that while judges may attend presidential events like the State of the Union, a rally like this is “a far cry” from such occasions. He emphasized that Bove should have recognized the event’s political implications, stating, “It should have been obvious to Judge Bove… that this was a highly charged, highly political event.”

The complaint does not automatically trigger a formal investigation. The chief judge of the circuit can choose to dismiss the complaint or appoint a committee to further investigate the matter. Roth argues that Bove’s actions raise concerns about his impartiality in future cases related to Trump, stating that reasonable observers might question whether Bove’s presence at the rally jeopardizes his ability to remain unbiased.

In response to the controversy, a representative from Bove’s court office declined to comment. The situation has sparked significant debate about the influence of political affiliations on the judiciary, especially regarding judges appointed by Trump.
