Kay Flock Seeks Appeal Against 30-Year Prison Sentence

Kay Flock, a 22-year-old rapper, is challenging his recent sentencing of 30 years in prison following multiple guilty convictions. His lawyer, Michael T. Ashley, has filed a motion arguing for a reconsideration of the sentence, which also includes five years of supervised release upon completion of prison time. According to documents obtained by Complex, Ashley believes that Flock should either receive the statutory minimum of 10 years or be subjected to a multi-year 11-point “punishment plan.”

The proposed punishment plan would require Flock to relocate to Los Angeles, obtain his GED, refrain from illegal activities, and use social media platforms to publicly denounce violence. Despite these suggestions, legal experts view the likelihood of this plan being accepted as low, especially considering the prosecution’s push for a significantly harsher sentence.

In this case, Assistant U.S. Attorney Michael R. Herman argued for an aggregate recommended sentence of 50 years under the United States Sentencing Guidelines. Herman emphasized that such a lengthy sentence is necessary to reflect the serious nature of Flock’s actions, stating that it would be “sufficient, but not greater than necessary, to satisfy the purposes of sentencing.” The prosecutor highlighted the “egregious nature of the defendant’s conduct” and the harm inflicted on the community.

Flock’s convictions include serious charges such as racketeering conspiracy, use of a firearm resulting in death, attempted murder, and assault with a dangerous weapon. These charges relate to four separate shootings that occurred between 2020 and 2021, which prosecutors allege were conducted to further the interests of the Sev Side/DOA gang, of which Flock is a prominent figure.

During the sentencing, Judge Lewis Liman acknowledged that Flock was not directly responsible for the shootings. He noted, “I recognize you were not the gunman. In some ways, it was a measure of the fact that you were a leader that you distanced yourself from the shooting.” Despite this perspective, Liman underscored the need for accountability in Flock’s actions.
